Most areas of this website are accessible without providing personal information. However, access to certain services, such as the MyNORQAIN account, online orders, watch registration, and newsletter subscriptions, requires the provision of personal data. Users voluntarily enter their personal data in the designated fields to enable NORQAIN to provide the requested services.

The hosting of this website is provided by Infomaniak Network SA, Geneva, Switzerland. Data is stored on servers located in Switzerland.

NORQAIN processes personal data in accordance with the Swiss Federal Act on Data Protection (nDSG, in force since 1 September 2023), the Ordinance on Data Protection (DSV), and, where applicable, the EU General Data Protection Regulation (GDPR).

     Watch registration data: for the duration of the watch guarantee plus 3 years.

     Cookie and analytics data: as specified in Section 9 (Cookies); typically 13 months maximum for analytics cookies.

     Log file data: 12 months for security and operational purposes.

     Identity verification documents: deleted within 30 days of order completion unless a legal obligation requires longer retention.

     HubSpot Inc. (Ireland/USA), CRM, marketing automation, contact forms, and newsletter management. Transfers governed by SCCs and HubSpot's Data Processing Agreement. HubSpot is certified under the EU-US Data Privacy Framework.

     Google LLC (USA), Google Analytics (website analytics), Google Ads (advertising), Google Fonts (website display). Transfers governed by SCCs.

     Meta Platforms Ireland Ltd (Ireland/USA), Meta Pixel and advertising tools used for targeted advertising on Facebook and Instagram. Transfers governed by SCCs.

     Infomaniak Network SA (Switzerland), website hosting. Data remains in Switzerland.

     Payment processors, secure payment processing; NORQAIN does not store full card details.

     Logistics and delivery partners, for product delivery and returns management.

     NORQAIN plate engraving and customization partners, for personalized product manufacturing.

8.2 Legal Disclosure

NORQAIN may disclose personal data to competent authorities or third parties where required by law, court order, or to protect the rights, property, or safety of NORQAIN, its customers, or third parties.

8.3 Business Transfers

     Right to restriction of processing (Art. 18 GDPR): you may request that processing be restricted in certain circumstances.

     Right to data portability (Art. 20 GDPR, where applicable): you may request your data in a structured, machine-readable format.

     Right to object (Art. 21 GDPR): you may object to processing based on legitimate interests, including for direct marketing purposes.

     Right to withdraw consent: where processing is based on consent, you may withdraw at any time without affecting the lawfulness of prior processing.

NORQAIN cannot guarantee absolute security but is committed to promptly addressing any data security incidents in accordance with applicable notification obligations.

Some of NORQAIN's service providers are located outside Switzerland and the European Economic Area (EEA), including in the United States. Where personal data is transferred to countries that do not offer an equivalent level of data protection, NORQAIN ensures appropriate safeguards are in place, including:

     Standard Contractual Clauses (SCCs) approved by the European Commission and adopted by the Swiss FDPIC.

     Adequacy decisions where applicable (Canada is recognized as adequate by the EU Commission).

     Certification under the EU-US Data Privacy Framework where applicable (e.g. HubSpot).

 

15. Automated Decision-Making

NORQAIN does not use fully automated decision-making processes that produce legal or similarly significant effects on users (Art. 22 GDPR). NORQAIN may use automated tools for purposes such as personalized product recommendations and marketing segmentation; these are based on legitimate interests or consent and do not produce legally binding decisions. 16. Changes to This Privacy Policy
